(Bismarck, ND) -- A prison inmate is getting a new trial after being convicted of assaulting a guard.
The North Dakota Supreme Court granted ruled Thursday that 45-year-old Duane Landrus would receive a new trial. Justices ruled that jurors in the case weren't properly instructed.
Landrus was charged with aggravated assault in August 2019 for the March 2019 incident.
